Mother being intoxicated in front of child leads to father obtaining physical
custody \ \
After relocating to North Carolina and being intoxicated in front of her children a New
York court ruled to modify the prior custody order, thus granting a New York father physical
custody. According to a New York Law article published December 12\super th\nosupersub
, 2012 the Family Court found that the mother willfully violated the child custody order.
\ Specifically, the court ruled that the mother\'92s
actions were willful because she never provided the father with her new address and phone
number after relocating. The mother attempted to appeal the Family Court\'92s findings.
On appeal the court found that there was no basis to modify the lower court\'92s findings.
The appellate court found that the mother\'92s judgment was unreasonable and lacking. Additionally,
they found that her lack of judgment was a result of her admitted alcohol abuse and mental
health illness. Due to these factors the court found she was currently unfit to be the sole
