A motorcycle rider went flying through the air as a result of a careless driver. Let
me tell you what happened. I'm Arthur Elk, managing partner here at Elk & Elk. And often
times we see these tragic stories. We represented a motorcycle rider who owned a Harley Davidson
for many years and this was his means of transportation when the weather was appropriate. He was on
his way to work and a distracted driver, heading in the opposite direction, went left of center
striking his Harley Davidson and throwing him through the air. He must have flown at
least 30 feet. When the police got there -- and we found this out from the police who were
first on scene, when the police got there -- they thought for sure he was a dead man,
that there was no way he could survive this accident. He was immediately taken to a trauma
center where they dealt with numerous injuries. Today he's able to function in not a normal
way, but as best he can given the severity of his injuries. However, had we not been
diligent in our investigation of this claim we wouldn't have found out many things that
were needed in order to prove that this driver was in fact not just a careless driver but
this driver was a distracted driver. We were able to get the mobile phone records and find
out that this driver was texting at the time of the accident and that's why this driver
went left of center. They were so busy texting that they did not see the motorcycle, they
veered left of center and that's why it's so important for us to be vigilant in, in
making sure that our children and everyone we know does not text and drive; does not
utilize their cell phones while they are driving in a way that can be distracting to them of
other vehicles on the highway. It's hard enough to see a motorcycle. But when you're distracted
by many things that can be distracting within your automobile, such as your mobile phone
or the radio or many other or the navigational system in your car, these are things that
you need to put aside. And you need to keep your safety and the safety of everyone else
on the highway primary before all of those communication devices are utilized within
