How long does the bankruptcy process take? Hi. My name is
Eric Engel. I'm a bankruptcy attorney with the Engel Law
Group in Seattle, Washington. This is one of the most common
questions get. How long your bankruptcy process will last
will depend on whether you file a Chapter 7 bankruptcy or a
Chapter 13 bankruptcy. In a Chapter 7 bankruptcy, the
process is usually 90 to 120 days. However, in a Chapter 13
bankruptcy you enter a re-payment plan so the process
is much, much longer. It's usually anywhere from 3 to 5
years, in other words, 36 to 60 months. The beginning of the
process is essentially the same. You file your petition for
bankruptcy protection which gives you your automatic stay.
And then you have what's called a meeting of the creditors about
30 to 45 days afterwards. From there, there is a process of
confirmation if you're getting Chapter 13 re-payment plan or a
process of completing the discharge in a Chapter 7. Why am
I telling you this? I'm telling you this so you understand what
the basic timeline is for a bankruptcy, so you know what to
expect as you start this process. We deal with bankruptcy
on a daily basis and we can help you. Call us at 206-625-9800.
