Hi, this is Chuck Boyk. I'm often asked how
long does a person have to present a personal injury case?
And the answer is that there's no magic answer.
Each individual type of case has a different statute of limitations.
So, for example, if you have a negligent situation,
and that would be a situation like a car accident (um..)
or something like that, the statute of limitations is two
years from the date of the accident under Ohio law for an adult,
for a person who's under the age of 18 which is considered a minor,
under Ohio law you have two years after the persons 18th
birthday or the day before the individuals 20th
birthday to pursue such a claim. For medical malpractice case
you have one year from the dates you knew or should have known
there is malpractice, under Ohio law for a dog bite situation
the actual statute of limitations is six years. So because there's no magic
answer if this question comes up,
you need to contact an attorney right away
in order to protect your legal rights.
