Today I'm going to talk about the penalties associated with the second
offense
super EXTREME DUI. Now what is a super EXTREME DUI?
Well technically it's the other extreme DUI which is .150
up to .199 but there's an enhancement provisions in the statute
if you're to or above its called the super EXTREME DUI.
So if you have a DUI with a .20 or higher
and you have one prior DUI in the last seven years, it doesn't matter if it's a
regular DUI or extreme DUI
any type of DUI the you were subject to these following mandatory minimum
provisions: You'll be facing six months in jail, thats 180 days
in jail with non of them suspended mean you'll have to do every one of those
days.
The jail costs will be fourteen thousand five hundred dollars which you have to
pay,
the fine and surcharge on top of that will be four thousand six hundred forty
nine dollars,
you'll be required to do a substance abuse screening or whatever classes they
recommend.
Its fifty dollars for the screening and 36 classes that's the minimum
that runs 585 dollars. As far as a license suspension
you get a one-year license suspension
and then for the next two years after your license back
you'll be required to have an ignition interlock device on your steering wheel
and that'll run 2000 to 2400 dollars over that two years.
Now what is this device? I's a breath testing device that you have to blow into on your
steering wheel to start your car
and every 15 minutes after it's running you have to blow into it again to keep it
running.
Then every 90 days for the next two years,
you have to take it down and get tested where they download the chip to
make sure
that you havn't been driving with alcohol in your system. Now
on top of all that you're increased insurance costs will be three thousand
dollars a year higher than it is now for the next three years.
That's nine thousand increased insurance cost
and the sr-22 requirement which is a rat out provision that's where the insurance
company can rat you out to the DMV
if you don't maintain insurance. That's going to run you five hundred dollars a
year
or 1500 over the next three years. Lastly they'll make you do thirty hours of
community service.
So, if you were stopped and convicted of a second offense super EXTREME DUI,
you did your six months in jail, even though you could get up for work release
12 hours a day, but you did six months in jail
you paid your 14,500 in jail cost and another
4600 in fines, and said I will just take the bus,
it'll still cost you 21,684 dollars over three years,
and if you do want to drive and decide to get insurance, add nine thousand dollars
on top of that. Now you're up to 30,000 dollars.
Very serious stuff. Other repercussions, If you have a CDL,
it's gone, if you are a doctor, nurse a pilot lawyer,
give a real estate license, if you're in government or military
anything like that you're probably lose your job, lose your clearance,
lose your professional status. Now if you go to our victory section
