An insurance company wrongfully blamed a motorcyclist for striking a dog that ran into his path
at night. Hello. My name is Michael Eisner and I work for the law firm of Elk & Elk.
This is what we did for that individual. First, we tried to educate the insurance adjuster
about the liability dog laws in Ohio. That for any injury that's caused by a dog, the
dog owner is strictly liable with very few exceptions -- none of which applied. The insurance
company didn't listen to our discussions and arguments so they forced us to file suit on
behalf of that gentleman. When we filed suit, we went through a discovery process to prove
to the insurance company that they were wrong both on a legal and factual basis. The insurance
company would not relent. They continued to blame the innocent party for what happened
to them. So we filed motions with the court. And the court ruled that as a matter of law
the owner of the dog was responsible for that motorcyclist's injuries. We then were able
to resolve the case by going through a mediation process. Why did I tell you about this case?
