If your cancer was diagnosed earlier, would you still have needed the radiation therapy?
Would you like to learn what this is all about? Come join me as I share with you this great
information. Hi. I'm Gerry Oginski. I'm a New York medical malpractice and personal
injury trial lawyer practicing law here in the state of New York. In a failure to diagnose
cancer case, one of the things that we look at is how would your treatment or your outcome
have been different if your condition had been timely diagnosed? And in order to understand
that, we now have to go ahead and try and reach out to your oncologist, the doctor who's
treating you now for treatment for your cancer. And the question that has to be posed is if
your condition had been timely diagnosed -- maybe when you were stage one or even stage two
-- how would your treatment have been different? Would you still have needed radiation therapy?
Would you have needed surgery? Would you have needed chemotherapy? And now, by talking to
your treating oncologist or an expert oncologist, we'll have a better sense of whether or not
you would have still needed those type of treatments modalities. Because if the treatment
or outcome is different, now it shows to the jury ultimately when we go to trial the significant
differences that occurred and the damages that you suffered as a result of that extended
delay before a doctor actually diagnosed your condition. So why do I share this great tidbit
of information with you? I share it with you just to give an insight of what goes on in
a failure to diagnose cancer case here in the state of New York. You know, I realize
