What is the Second Injury Fund? In Iowa, there is what’s called the “Second Injury Fund.”
What that fund does is provide benefits to you if you have a leg injury, an arm injury,
a hand injury, foot injury, what’s called a “scheduled member injury” and you previously
had an injury to an arm, a leg, a hand, or foot. The previous injury, the old injury,
doesn’t have to be work related. So you could have had football injury as a kid and
had surgery on your left knee and then come in to my office with an Workers' Compensation
injury to your right knee. If that’s the case, you can get what’s called Second Injury
Fund benefits, the beauty of the Second Injury Fund is this, it changes a scheduled member,
a knee, a leg, an arm, a hand injury, to an injury that is compensated based on how does
the old injury, how does the new injury combined, affect your ability to work? That results
in significantly higher benefits typically, and is something that should be pursued and
looked into. In many cases, my clients don’t even know Second Injury Fund exists, and I
promise you that the insurance company for the employer is not going to tell you about
it or discuss it with you either. For that reason, it’s important to talk to an attorney
