I'm Robert Todd, and I'm here to answer the question. What is a Petition for Divorce?
Well, in some of the states, a Petition for Divorce is called a Petition for Dissolution
of Marriage, but whether it's a Petition for Divorce or a Petition for Dissolution of Marriage,
it's the same instrument. It is the complaint or the initial pleading that a spouse files
with the court that sets forth that they meet the jurisdictional requirements for the court
to have jurisdiction over the divorce, that the marriage is over, that that spouse wants
specific assets or liabilities, and that spouse wants custody of the children, and the child
support, and that that spouse wants some type of support or does not want to pay support,
to the other spouse. It is basically the initial pleading that starts the whole divorce process.
