The rising blood alcohol defense works
best in a situation where you got pulled over soon
after you finished drinking, and there
was a gap in time from when you were actually
driving to when you took the blood or breath
test, in usually a gap of about 45 minutes to an hour.
And that's often the case in a DUI investigation.
In many DUI cases, we're able to offer evidence of the drinking
pattern, evidence of the timeline, and expert testimony
to show that, even if our client tested above the limit,
that he was, or at least may have been below the limit
at the actual time of driving.
And in many cases, we've been able to use this defense
to get charges reduced or outright dismissed,
especially at jury trial.
If you're in this situation, we invite
you to call us here at Shouse Law Group.
Tell us the facts and details of your case.
And we'll evaluate whether the rising blood alcohol
defense could be effective for you.
