Everyone that calls us, generally, they've lost money in an investment or series investments,
but they also think something wrong. So, we walk them through that process. We've literally
heard, I think, just about everything that could happen in an investment fraud situation.
We've also handled claims against just about every brokerage firm. So, not only will we
have been familiar with the scenario, maybe the investment product, but we'll also know
about the investment firm, the types of compliance and supervisory issue. And that comes with
so many, having handled so many of these cases that we're going to have that familiarity
with it from the get go. So, we just talk to them. You know a lot of lawyers say there's
free consultation. Well, generally, for solos and people that don't have the resources that
a firm like ours has, it's a ten minute phone call and that's it. Well, we really think,
I think we take it to the next level. We talk to people as long as we need to to get information.
We have them send us documents. We have people send us information in trash cans and Rubbermaid
containers, statements and correspondence. We really spend whatever time it takes to
understand what happened. And then if we believe they have a claim we'll explain the process.
Like I said, most claims against brokerage firms go through mandatory arbitration. It's
not like court, so civil litigation attorneys don't have experience with arbitration; it's
a totally different set of rules. It's a different ball game altogether. So, we walk the potential
client through the arbitration process. What we need to start the claim, we file what's
called a statement of claim, it's very similar to a complaint, and it goes through the FINRA
arbitration process. From beginning to end the FINRA arbitration process is generally
twelve to sixteen months. That may sound like a long time, but court cases these days can
go from anywhere from three to six years. So, the FINRA arbitration process is relatively
efficient compared to the court case process.
