Registration of a restriction is found under the Network Services signpost, under the e-RX1 link.
Enter the title number and select Next.
Check that the title is correct, if it isn't then select previous to amend it.
The next stage is to enter whether it affects the whole of the registered estate or a registered
charge. If it only affects part of the registered estate you'll need to apply by post or DX.
The system then wants to know if it's a standard or non standard restriction, so in this tutorial
we'll choose a standard restriction in Form B.
A Form B restriction is one of number of restrictions that have variable in fill's completed by
drop down menus or free format fields. We'll choose a No disposition type of restriction
to demonstrate the procedure. With this type of restriction you need to enter details of
the deed that created the trust in this free format field.
On this screen you can see the wording of a Form B restriction, so you can check to
make sure you have selected the correct restriction type before you carry on.
You now need to enter the full name of the applicant, either an individual or organisation.
If there's more than one applicant then just enter one of them here as you can add the
others later. Remember that the applicant is the client and not the Conveyancer. The
fields aren't case sensitive, but anything you type here will appear in your PDF Acknowledgement.
You can see the name of the applicant is now displayed. You can Add another applicant,
Edit this applicant if there are any errors or remove them. When you've done select next.
The next step is to provide details of youir entitlement to apply for the restriction,
so select the appropriate option on the screen. Depending on the option selected you may be
asked to provide evidence of entitlement. Then enter your customer reference so you
can identify the client for your own records. Before you submit it you can view the application
details in PDF format using this link. It will open in a new tab or window and you can
print or save, and once finished you can close it by clicking on the X.
When you're sure everything is correct you can press submit. By pressing Submit you are
agreeing to pay the appropriate Land Registry fee.
You'll then get confirmation that the application has been submitted successfully. Most applications
are then completed automatically with updated documentation available almost straight away
in your PDF downloads. If Land Registry need to address any elements before it can be completed
then it will appear in your PDF downloads later on. It will be sent by post or DX if
electronic delivery isn't possible. This will be sent to the address associated with the
VDD account used to pay the fee. You'll also be given an application reference here which
you should make a note of in case you have a query, and if the day list is open a priority
date and priority time. That concludes how to lodge a standard restriction
in form B.
