Hi, I am Scott Maasen with the Maasen Law Firm. Today, in this video, I want to talk
to you about vehicular homicide type of cases and possible penalties.
In Arizona, there usually are two different types. Either a Manslaughter charge is when
someone is driving on the road, they are acting recklessly, which means they usually have
drugs or alcohol in their system. Then the accident occurs and someone dies. That's a
manslaughter charge. It's a Class 2 dangerous felony, so it's a very serious offence. It's
up to a 7-to-21 year prison range even on a first offense if the case isn't reduced
or negotiated down.
The second type of charge you have is second-degree ***. In Arizona, that is more serious than
a manslaughter offence. That shows that someone acted in such extreme indifference to life
and had to get alcohol or drugs in their system and someone died. The example on that would
be someone going down the freeway at over a 100 miles an hour, at a very high speed
with drugs or alcohol in their system. Then they cause an accident and someone dies in
that. So, very serious. In that type of second-degree ***, the prison range is anywhere from
10 years to 25 years in prison, even as a first offence.
The good news if you're facing these type of charges, they have options. There are a
lot of things that can be done and investigate your case. Things can be done on your behalf
to get you through that case and not have those penalties happen to you.
