What happens if I win my court case? You know when someone we represent has gone through
the litigation process in a disability claim, they're often disappointed to learn, we tell
them this at the beginning of the case, disappointed to learn that a federal judge, all he can
do is give you your back benefits. He can order a portion of your attorney fees paid
but he can't say to the insurance company, "We're going to pay you for next month." The
insurance can deny you the next month. You can be hit by a bus and die, in which case
you wouldn't be paid. They could do video surveillance, so when you go through the litigation
process in one of these disability claims, if the judge ultimately decides your case,
all he is going to be able to do is order the insurance company to pay you what you
were owed in the first place. There's no punitive damages, there's no damages for your pain
and suffering for the fact that you actually may have lost your house, anything like that,
so that really emboldens these group disability insurance companies to say no and to send
you that denial letter. That makes these cases very very tough for the individual, and they're
actually tough to handle as well.
