My name is Jayson Lutzky. I'm an accident attorney in the Bronx, New York. I have about
thirty years of experience practicing law. Today, I would like to talk about a 2009 accident
that occurred between a taxi cab and another car in Manhattan.
One must use caution while making left-hand turns. Even still, accidents can still happen
in the process. In October 2009, one man's finger was seriously injured after a motor
vehicle accident. The man was driving southbound on Broadway in Manhattan, according to an
April 22, 2013 New York Law Journal article, when he decided to make a left turn onto West
145th Street. A taxi driver was heading northbound on Broadway
and crashed into the man's car while it was turning left from the opposite side. The accident
victim states that he (the victim) still had a green light for turning left and for that
reason the taxi driver must have had a red light. On the contrary, the taxi driver and
a witness, the passenger in the taxi, said their light was green. Additionally, the taxi
driver says he was traveling slowly, at fifteen miles per hour, and was driving carefully.
The passenger witness agrees. The victim's lawyer challenged that because the accident
occurred early in the morning, before rush hour. Therefore, according to the attorney's
logic, the road would have been relatively empty, so it would be unlikely for the taxi
to be traveling slowly. The crash injured the victim's finger, which
needed surgery, temporary pins and physical therapy. The victim alleged negligent operation
of the taxi. The jury awarded the man $85,000, which is 85% of the taxi's insurance policy.
The funds were awarded "past pain and suffering." Thankfully, the man's injuries were not permanent.
