What is a nursing home neglect case? I'm Dan Pruitt, Nursing Home
Injury Lawyer in Greenville South, Carolina. A nursing home neglect
case is really
two things. First of all, it's a Personal Injury case.
It could involve a broken hip, for example,
if a staff member is transferring a patient from
bed to chair, drops the patient, and causes them to break a hip.
It could be a pressure ulcer. That could be
where a staff member is supposed to come in and turn and reposition the resident
every two hours, and they just don't have enough
time in the day to get all their work done, so then they neglect the resident,
and skin breakdown occurs. Or it could even involve death,
where a patient is not properly monitored, their condition worsens, the
doctor's not notified,
and the patient unexpectedly dies. Another aspect of a nursing home
neglect case
is that it's a business practices case. By that, I mean
members of the Board may decide to run the company in a way that puts profits
ahead of patient care.
For example, some facilities decide to
run the facility with bare-bones staff. With fewer staff members,
nursing assistants, registered nurses, et cetera, the
staff at the facility does not have enough time to go turn
each resident every two hours, as required by law,
and injuries such as pressure ulcers can result.
In addition, sometimes the facility does not have
adequate supervision of the staff by
registered nurses or trained physician assistants who can make sure
that each residents health care needs are being met.
Finally, there could be a problem with a failure to train the staff,
whether it's to train the staff on the appropriate policies and procedures
for providing safe care to each resident.
Or failing to make sure that the staff is
properly trained in how to monitor health care needs.
