on the line with me is dan Bongino conservative commentator former police
officer for the New York Police Department former Secret Service agent
and currently a candidate running for Congress in
as a republican in maryland in the sixth district Maryland
his website is Bongino be 0 NG I and all
dot com and Dan welcome back to the program
always good to talk to you Tom thank you can always nice to have you on
your your good guy are very much I
even though we disagree and so many things I i've got to know you over the
years you are definitely good guy but where you running up
is a primary run there is a primary yet
the okay nominal okay so so
for our republican listeners in maryland dans running for the 6th district of its
a close primary or not but
it yes our are registered republicans
the listen carefully this guy he's is a good guy arm
damn I wanna talk with you about about the stop-and-frisk
thing they got basically blown up by the
well actually not a got it got temper shall we say bye this federal judge in
in New York City and also this young man Israel Hernandez
Kalash who was an award-winning graffiti artist
and been a graffiti artist means you're living kinda on the edges law
because graffiti is graffiti right and
even even when it's art and a
police officer demanded that he stop he didn't think I taste him
and it killed him he was shot with a tease taser gun when the car in spray
paint a building
um the where would you prefer to start
yeah well stop and frisk is a great ok topic for my
you know me and you Tom actually share a lot in common I know that surprises you
sometimes but I was there kiddo drove around with a bumper sticker on my car
that said question authority
so I the cleft between my libertarian streak
and I think yeah I your spray cover your interesting blend the politics I'll call
it as I don't know that I civil libertarian streak yeah it's not as
thickest someone with the top and frisk issue is a sensitive one for me haven't
been a police officer
and stopped and frisked people my having grown up in the streets in the in the
city in New York City and having been stopped and frisked myself and
circumstances I felt inappropriate you know I've seen it from both sides
now I'll say this summer the judge shining which island I think some other
remedies
world a little absurd you know goal of I having
you know police officers where video cameras I think was a little excessive
but
what are the police officers who testified in this case apparently
however the New York Times pieces said that there were these informal quote is
for numbers of people glad stop and frisk right I can tell you from my time
and I called quote is
but they're generally called performance measures Tom or some other
and out to a fancy terminology UK to knock yourself in legal trouble
and I strongly strongly object there's no
constitutional basis whatsoever for pulling people over
an ex post facto making up a reason why you did it
because you have to fill whatever you wanna call it a performance quota
or a measure Prado that and and and no one other things that that I've heard
several times and I'm not sure if this is
actually true or not mean and may even tell me perhaps tan
is that in New York possession of a small amount of marijuana is really not
a crime
and or it's a parking ticket kinda crime
right but display marijuana in public
is a crime in this is in in order to you know discourage people from smoking pot
in public right key is pressed see other people
get the BRI that mean that kinda stuff but
if somebody's caught with pot they and in a stop in for a situation they find
themselves in this bizarre catch-22 because that the police officer says
empty your pockets and show you what's in your pockets
if they say no then they're committing a crime which is more serious than a
trafficked and then a parking ticket or jaywalking ticket are
luv gov refusing a lawful order a police officer
and if they say yes and pull a joint out they are now committing the crime of
publicly display marijuana and they get arrested for one or the other
is that the case well what I found no I did it
could it be yes but that's not what I found what I found was that they wanted
to arrest you
you know what are the jokes we had was the or you hear people say this
but felonious Moberly or something like that like a crime people would make up
after the fact
right now if they could you know with disorderly conduct I mean there's use
random kinda open-ended
crimes you can charge people with if you would
stop and frisk them and maybe you didn't have the exact Terry versus Ohio that's
a legal case
reasonable suspicion to do that these those are the things I
found disturbing I didn't witness to be always hear people chatting as always
chatter in the cops and firemen are really good guys I mean I worked there
in the
the secret service ends at work with but of course is always a few bad apples in
pressure I found tom was pressure coming from the boss is not the cops I mean
now the Cubs I knew when to roll call wanted to go out there
yea lets go out there and just randomly first became one every two hours to
people
there's a lot of pressure from management de Lyon politicians what a
quite crime rate
and that's where these performance measures things come in and that's why I
don't believe the politicians in this
are really telling everybody you know the full story the program needs to be
modified but I don't think
it should be scrapped completely out that video cameras are necessarily the
best way for it either
well they they've done well actually a lot with her in police cars
in stopping inappropriate behavior by police officers
sure and i think thats that's fine but when you're on a foot post by yourself
they haven't been there two o'clock in the morning in the 75th freezing any
guess I'm not
defending illegal stop and frisk technique I'm not but as a
if I a video camera on me and it's two o'clock in the morning there's always a
hesitancy to act
knowing that your they're never gonna see the full context of what you're
saying
and a horse puppets a little different have a microphone it doesn't really get
the whole thing
I'm but you know I haven't been stopped myself again after I left
bear is that you know why just %ah before it does breed
distrust in the community I don't think there's anything more important between
a police department in the community
then a you know I've vibrant sense of trust yeah I've
I've I've said this for years not believe you agree with me on this
that our future is in the hands of our teachers are present is in the hands of
our police
and in both cases there wildly underpaid
and vastly under-resourced in terms of
community please seen and genuine teaching
I couldn't agree with you more time to think about who else do you pay
a at that has the ability to take your life in your liberty
I'm as a check in for work every day as a cop yeah
yeah I they are public service for you know farming is one in a run into
burning buildings every
things we were run away from their running toward I do agree with him
said that publicly many times that police fire in our federal agency
our military I think these are guys should be paid and I think the education
requirements we can bump up a bit
and the salaries as well and maybe that's a better solution
may be better training may be better civilian oversight board
I mean the ones I found in New York City when I was a right at they were a little
I found to be a little vindictive time Syrian you know there were times that
interest you at all
the cable to tell you is true is way I had witnesses here's how it happened
for itself that what's on the way to do it what's your take on this young man
who was
who is taste it seems to me that at some point tasers are
you know we we've had we had a robust debate years ago about when a police
officers you pull a gun
and and when they should discharge in and I don't we ever had that debate
about a Taser and these things kill people more often than they should
yet seems they were chasing him for a while as well but my take on this is is
a practical one my time in the police academy I found the day
lowered the standard the physical standards I
for people in order to get more people to pass this is not a man woman thing so
I'm
it yeah did I get man-woman common they were some people to combat
yeah and they did to get more people through and I think this is the result
are more people rely on the equipment
rather than say their ability to talk or their ability just buy a good physical
presence stopper
dangerous situation before it started worse at a certain point
yeah Arthur some crimes like been a graffiti artist the
you know if you can't catch the guy you just let him go
because the alternative is to is to possibly killing
by yeah I'm and thats what are the reasons in New York they call of vehicle
pursuit if it gets too dangerous senior right here's a look at the car ran a red
light
is it worth running down four or five kids in the middle of the street
to catch the guy and ensure you get a ticket for red light amid
you know marginal benefit marginal cost say it radical point here in this case
the
I don't know all the details but over the first revolver knife
here helping keep their about yeah I'm with its dan Bongino his website find
you know be 0 NG in-os dot com
