parry sent me this story from Think Progress about a high court ruling
saying that upskirt photos are legal
in Massachusetts it is not against the law to secretly take photographs up a
woman's skirt
in Massachusetts according to the state Supreme Judicial Court
the court dismissed charges against Michael Robertson who was arrested by
Boston transit police
for taking photos and videos up women's skirts and dresses on the subway
the judge sympathize with the notion that a woman
should have a reasonable expectation not to have secret photos taken up her skirt
when she goes out in public but she ruled that state law doesn't address
that the Massachusetts peeping tom laws as written
only protect women from being photographed in dressing rooms or
bathrooms when they're
undressed since upskirt photos are taken a fully clothed women in public
they don't count according to the court now I have a problem with some of the
analysis on those people are saying well
the law is poorly written and the judge was just interpreting the law as written
the judge could also interpret the law to mean
that when someone has covered a part of their body
that is an intent to keep it private
and therefore there is a reasonable expectation of privacy so even if you
can
put a camera down at an angle where you can fill me up a woman skirt or dress
the fact that she covered it is a signal
that there is a their is a reasonable expectation of privacy now in spite of
all this
politicians in Massachusetts are working feverishly
to get this change and I think that the judge's decision
release skirted around it the the real issue I think so
bite an important ruling just because it let everyone know the head
there was this loophole that there is this flaw in the writing up a lot so it
now it will be fixed
and presumably this this will be a legal in a in a short time this would apply
assume too many equally right whether it's a man who wear skirts or dresses or
if you have for example a Scottish bagpiper whatever
I would assume that upskirt legislation is gender-neutral
