Class Actions
Picture yourself relaxing in front of the
TV. You hear on the news that the store where you bought your TV, King of TVs, charged $100
in illegal fees to 20,000 clients. You also find out that a court has authorized
a $2 million class action against this store. This means that one person is trying to get
this money back on behalf of all the clients who lost out.
You want to know how to be part of this class action.
If you are one of the clients charged illegal fees by The King of TVs, you are automatically
included in the class action. You don't have to pay anything or fill out any forms.
But you can decide not to be part of it. You must make that choice soon after the class
action is authorized. If you drop out, you can go after the store yourself, at your own
expense, by making a separate claim.
If you stay in the class action, you must make an effort to stay informed about the
case. This way, if the class action is won and the clients are owed money, you will know
how to make your claim. To find out about the case, or to get the
name of the lawyer representing the clients, you can check the Canadian list of class actions
or the Quebec registry of class actions. You can also call the Fonds d'aide aux recours
collectifs - the class actions support fund. But be patient! Class actions sometimes take
several years to come to an end! So there you go, to learn more about your
rights and obligations in general, visit educaloi.qc.ca.
