bjbj Hello and welcome to our short presentation about incident notification requirements under
the new work health and safety laws. So what s changed for incident notification from the
current OHS legislation? From the first of January 2012, when the new Work Health and
Safety Legislation commences, you will need to notify WorkCover and your insurer of all
serious injuries, illnesses and dangerous occurrence. There are changes to the types
of incidents that are notifiable, which I will go into a little later; and you must
now preserve the incident scene until an inspector attends or WorkCover directs otherwise. So
when should you notify an incident? All fatalities, serious injuries, illnesses, and dangerous
incidents must be notified to WorkCover immediately. It is the responsibility of the person conducting
a business or undertaking (known as a PCBU) to ensure this occurs. The primary purpose
of incident notification is to enable WorkCover to investigate serious incidents and potential
breaches of the Work Health & Safety legislation as soon as possible after they occur. So when
is an incident notifiable? You must notify when the injury or illness requires a person
to have: immediate treatment as an In-patient in hospital, where the person needs to stay
overnight , or when a person requires immediate treatment for: Amputation A serious head,
eye or burn injury Degloving or scalping A spinal injury Loss of bodily function A serious
laceration Or, if a person is exposed to a substance, and as a result of that exposure,
they require medical treatment within 48 hours, then WorkCover must be notified of that injury
or illness. Dangerous incidents must also be notified to Workcover. A dangerous incident
is one which exposes a worker, or other person, to a serious risk to their health and safety:
Notifiable incidents include: An uncontrolled escape, spillage or leakage of a substance.
An uncontrolled implosion, explosion or fire. An electric shock. An uncontrolled escape
of gas, steam or pressurised substance. A fall or release from a height of any plant,
substance or thing. A collapse, overturning, failure, malfunction or damage of plant. A
collapse or partial collapse of a structure. The collapse or failure of an excavation or
any shoring supporting an excavation. An inrush of water, mud or gas in an underground excavation
or tunnel and An interruption of the main ventilation underground. How to Notify The
notification to WorkCover can be by phone or in writing. To notify via phone call 131050
or visit our website for more information. It is worth noting that Workers Compensation
legislation has not changed and you still need to notify your insurer as well. You must
notify your insurer within 48 hours of a worker sustaining an injury or illness where worker
s compensation is payable. Please note that a PCBU must keep incident records for five
years. A person with management or control of the workplace must ensure, so far as is
reasonably practicable, that the scene of the incident is preserved until an inspector
attends or directs otherwise. So when can a person disturb the scene of an incident?
When they are directed by WorkCover or an inspector If you or emergency services need
to assist an injured person or remove a deceased person If you need to make the site safe from
risk of further injuries Or as part of a police investigation. In summary: You must notify
WorkCover and your insurer when a serious illness, injury or dangerous incident occurs.
You must notify these incidents either by phone or in writing via the quickest means
possible. Preserve the incident scene (so far as reasonable practicable) until an Inspector
attends or Inspector directs otherwise. If possible, preserve the site until an Inspector
arrives or directed otherwise. Keep all notifiable incident records for 5 years There are many
