Did you know in Massachusetts if you’re involved in a car accident you need to have
a minimum amount of medical damages to even bring a claim? It’s called a “threshold.”
Hi. My name is Neil Crowley. I’m a Massachusetts personal injury attorney with offices in downtown
Boston and Dedham. And what is a threshold? In Massachusetts, the threshold is $2,000
in medical damages. You can get medical damages by your medical bills or by lost wages. This
would entitle you to make a claim in court. If you don’t reach this threshold, unless
you have a permanent injury – such as a broken bone or perhaps a missing tooth – then
you wouldn’t be able to bring a claim in court. This is a filter that the system puts
in so that the courts aren’t clogged up by smaller cases. Why am I telling you this?
You may have been in a car accident and are not aware of this threshold. You may choose
not to treat for your accident, feeling that perhaps since the other person is at fault
you automatically have a claim, but you do not. This threshold applies to everybody.
