Hi, Glen Neeley here, board certified DUI defense attorney in Ogden, Utah. Today I want
to talk to you about the impound of your car. Many people call me and say that officer was
such a jerk that he impounded my car and it cost a lot of money to get it out. What happens
is after you have been arrested for a DUI, state law requires the officer to impound
your car. He can either do that or he can release it to somebody who is on title or
registration and normally, that person isn’t around. And so it is normal for the officer
in probably 95 to 98 percent of the cases your car is going to be impounded, inventoried
and searched by the officer and then you will have to pay a state tax impound fee to get
your car out and you pay that at the Driver's License Division or the DMV and then you have
to pay the costs of the storage and towing of the vehicle. One of the problems that we
have with the impound of the car is that a lot of the driver's license divisions or the
DMV is not open on Fridays. Well if you are arrested on Thursday night or Friday then
you have to wait the weekend until Monday to be able to pay the state tax impound fee.
By that time, you have racked up storage fees and towing fees with the towing company and
so, it is a little bit unfair that you have to pay those. Now there is not much that we
can do about that because of the state law. So if you have any questions about this please
