Cherri DiNovo: Yes our quest for gender identity and gender expression in the Ontario Human
Rights Code grew out of our work with the LBGT community in Parkdale-High Park. And
that work started with two women who came and asked to be married. And that was prior
to the law changing around same sex marriage.
We married them – it didn’t say anything about male or female on the marriage form
of the day – and sent it into Thunder Bay, seeing what would happen.
They by mistake at that point vetted that marriage and it de facto became the first
legalized marriage. Although Brent had done the first banns, ours became the first legalized
one. And we were very proud of that fact and that then led us down the road that took us
to Toby’s Law.
