One of the primary functions of an attorney is to determine the difference between a bad
result and medical malpractice. We do that by going through all of the medical records
and having those medical records reviewed by our experts.
Experts in the field of the specialty of the doctor involved in the care and treatment.
There is a major distinction between a bad result and medical negligence. A doctor is
not held to the standard of being all knowing or all powerful, practicing with a crystal
ball and certainly they don't need to be perfect. But rather a physician's obligation is to
act as the reasonable physician would under the circumstance.
If a physician acts reasonably, in other words if he acts as a reasonable physician would
under the circumstances and a bad result happens anyway they are not negligent and they are
not considered to have committed malpractice. However on the other hand if a physician fails
to act reasonably and there is a result that is untoward, they are in fact responsible
for that bad outcome.
