Your attorney is going into court to have a pre-trial conference as your case is approaching
trial. Is the judge who’s going to be meeting with your attorney and the other attorney
the same one who is going to be presiding at your trial? You want to learn the answer?
Come join me. Hi. I’m Gerry Oginski. I’m a New York medical malpractice and personal
injury trial attorney practicing law here in the state of New York. The short answer
is no, it’s not the same. What happens is there is a trial assignment judge in every
county in the state of New York. That judge will decide which trial judge your case is
going to be assigned to. And that comes up on a random, rotating basis depending on who
is available at the time your attorneys have finished picking a jury for your particular
case. The judge will then look at his roster of who’s available at that moment and then
decide who has the most experience for the type of case that you’re bringing. That’s
how your judge will be assigned to handle your particular case. So what happens after
that? After that, the attorneys will then have to go meet with that particular judge
and have him or her know exactly what your case is about. The judge will naturally begin
to ask if there’s a chance that your case can be settled. And then determine if it can,
try and enter into settlement negotiations. If it can’t, the judge is going to try and
tell you exactly when your trial will begin. So that’s it for today’s video. And by
