Mom is injured in a nursing home. She brings a lawsuit. The
nursing home has the nerve to argue that because Mom was still
in the nursing home while the trial was taking place, that
they were not negligent. Is that right? My name is James

just like that. At the time of trial, because Mom was still in
the nursing home, their entire defense was they weren't
negligent - that they must be a good nursing home. That is not
the case. When someone is injured in a nursing home, it
doesn't matter if they are still staying at that nursing home.
The nursing home should be held responsible for the neglect of
the past. And when that happens and they try to do that type of
defense, the public should be outraged. In this particular
case, we had a lady - an elderly lady - who was in a nursing home
for more than 15 years. She had an accident and when the case
came to trial she was still at that nursing home. And the
defense made such a big deal that she must be in a nursing
home and the family ratified their actions. Well, that wasn't
the case. At the end of the day we had a successful result. If
