Hi. It’s Gerry Oginski coming to you from the island of Jamaica. Come join me as I share
with you why you have to give your social security number to your attorney with you
when you bring a lawsuit. Hi. I’m Gerry Oginski. I’m a New York medical malpractice
and personal injury trial attorney practicing law here in the state of New York. I’m on
a quick vacation here with my wife and I’ve just had some ideas about some of the things
you need to know when you bring a lawsuit – especially for medical malpractice, for
accidents or even wrongful death cases – in the state of New York. One of the key reasons
why we ask you for your social security number is not because we need it. Because in reality,
we don’t need it. What happens is the defense lawyers want it. Why do they want it? Because
they want to do an investigation on you. They want to do a thorough background investigation
to see whether you’ve brought any lawsuits before. They want to know your history. They
want to be able to check your criminal background and they are entitled by law to get that information.
So that’s exactly why when you come into the office we ask you for your social security
numbers. No real reason for a plaintiff’s attorney to request your social security number
but it’s done for the purposes of providing your medical records to the defense as well
as giving it to the defendant if you have a valid basis for a case. So why do I share
this information with you? I share it with you just to give you an insight and an understanding
into some of the things that go on when you bring a lawsuit in the state of New York.
