-Infractions are not criminal convictions
under California law.
However as people apply for jobs,
more and more employers are doing background checks,
and when they do these background searches
for criminal convictions, all convictions,
they'll see, for example, a peace disturbance that
was reduced to an infraction, which is not
a criminal conviction, but the employer
doesn't understand that.
So people will ask us, how do we fix that?
And there's two ways that we typically will tell them.
We can go into court and file a motion
on their behalf for relief so that
that non-criminal conviction can be expunged
pursuant to recent changes in California law.
Also oftentimes what I will do and we do here at Shouse Law
Group is we'll provide some counseling for those persons
to how to answer those questions as a
follow up on a one on one interview with the perspective
employer.
