Once you have chosen your trade mark, it is important to seek to protection by way of
registration at the UK Intellectual Property Office, (the UK IPO). It is a common misconception
that by securing protection of a company name or a domain name, you will have done enough.
This is not true. To be in a strong position to prevent others from using your trade mark,
you need to be able to assert registered trade mark rights.
If you have secured a trade mark registration, you will be able to allege trade mark infringement
against a third party who can be shown to be copying. Often, this will result in the
other party acknowledging your rights, and ceasing use of the competing mark after they
have received a single approach letter; quickly recompensing the costs of seeking registration.
It should also be remembered that trade mark registrations are a form of property, and
as such they can be sold or licensed for considerable value.
