[Jason Handman] Good morning and welcome to another edition
of Getting Legal with Tim Misny.
Tim, we're back at our favorite spot
[Jason] the Diner on 55th.
[Tim] 55th and St. Claire where the food is great
and the coffee is even better.
[Jason] That's right. All right we've been taking questions from
your Facebook friends. [Tim] OK.
[Jason] Tens of thousands of them out there.
And let's go to this question
from Diana Riva.
[Jason] She writes, "If I'm hurt on the job
what should I do first?
And second, can they fire me?"
[Tim] OK.
The first thing you should do
if you're hurt at work
is to make a report of it.
Make sure that you make an official report
talk to your supervisor. Document it.
[Jason] Is that like a human resources thing?
[Tim] Whomever that may be. It may be your
immediate supervisor, it may be a co-worker
Whoever can document the fact that you were hurt.
[Jason] OK. [Tim] That's number one.
Number two, to answer her question -
and her second question is a very
prevalent question I get
about if you bring a claim
will I get fired?
The answer is absolutely, positively no.
You have a statutory right to
bring a claim through workers' compensation
to compensate you for your injury.
Your employer cannot impede that
and oftentimes, it's not between you
and your employer, the claim.
It's between you and my firm
against, through the workers' compensation commission.
[Jason] OK, so first I file the claim
with my supervisor, someone at work.
[Tim] Yes. [Jason] Then what do I do?
[Tim] You've got to call me right away. 1-800-55-MISNY
and it's very important
to get the case on track
to get it filed properly to ensure
you get the very best medical care possible.
[Jason] OK, and how can people get a hold of you?
[Tim] 1-800-55-MISNY
or visit my website www.misnylaw.com
[Jason] All right, thank you so much, Tim.
[Tim] Thank you, Jason.
[voice over] Thanks for watching.
