Hello. I am Julia House, a UK and European Trade Mark attorney and one of the Trade Mark
partners at Albright Patents LLP.
It is never safe to assume that a trade mark is available for use or registration. You
can appreciate that since Bass registered the first ever trade marks in 1876, hundreds
of thousands of trade marks have been registered in the UK. This means that whilst it may have
taken some time for you to arrive at your choice of mark for a new product or service;
you may not be the first to have thought of it, or indeed to have sought to register it.
Even though it can be irritating to choose an alternative mark at the early stages of
developing a new product or service; this will be infinitely cheaper and more time efficient,
than being forced to do so the day after your big launch party.
When you contact us with an initial enquiry, we will be happy to conduct a complimentary
search of the UK Trade Marks register for identical word marks in relation to the goods
or services that you intend to use the mark for. Likewise, if you have already have started
using the mark, and now wish to secure a registration for it, an identical search will make you
aware of any potential obstacles and you can be guided as to how to deal with any issues
that may arise..
We can also offer a broader scope of searching that will take into account similar marks,
and marketplace checks. This level of searching will incur a charge.
The Trade Mark team at Albright Patents LLP are experienced in advising clients as to
the availability of trade marks for use and registration. Please contact us if you have
a specific query.
