If a doctor is board certified can you still sue him for violations of the standard of
care? Would you like to learn the answer to that? Come join me as I share with you some
great information. Hi. I'm Gerry Oginski. I'm a New York medical malpractice and personal
injury trial attorney practicing law in the state of New York. The answer is yes. Whether
or not a doctor is board certified or not does not prevent you from bringing a lawsuit.
Now what you should know is that if a doctor is board certified it means he has become
certified and has achieved a certain level of basic knowledge and understanding in his
particular field of medicine. That does not mean he is the best doctor in the world even
though we would all like to believe that. The fact that a doctor has become board certified
means that they have gone through a rigorous four years of medical school, they have gone
through three, four, five or sometimes even longer years of training (known as a residency)
and then they have gone into private practice. And then to go on and take the examination
to become board certified they have to be in practice for a certain number of years
and gain practical knowledge in order to achieve that level of extinction. There are physicians
who are practicing medicine today, in the state of New York, who are not board certified.
Whether a doctor is board certified or not board certified has no bearing whatsoever
whether or not he violated the standard of care when treating you or someone that you
know. So why do I share this great information with you? I share it with you just to give
you an insight and an understanding into what goes on in a medical malpractice case here
