What is a prenuptial agreement? Hi! My name is Eric Engel. I am
a Seattle divorce lawyer with the Engel Law Group here in
Seattle, Washington. A prenuptial agreement is a
document that spells out what your property rights will be -
and what your spouse's property rights will be - in the event
that you get a divorce. The distinction of a prenuptial
agreement is that you enter into the agreement before you get
married. There are 3 basic things you need to remember when
executing a prenuptial agreement. One, you need full
and complete disclosure. If you don't disclose all your assets
your prenuptial agreement can be thrown out. Two, it needs to be
fair in its face. Usually what this means is, is that the other
side has gotten the opportunity to get their own counsel to
review the prenuptial agreement. And three, there needs to be no
duress. What that means is that you're not throwing this
prenuptial agreement 2 hours before you're getting married
and asking your spouse to sign it. If you do that, that's
called duress. And what that means is there's a good chance
it will be thrown out of court. Why am I telling you this? I'm
telling you this because you're thinking about protecting your
assets, which means you're thinking about getting a
