-One of the most common charges we see that out-of-towners
face, or tourists face when they come to Nevada for a good time,
is the trespass charge.
And trespass most frequently involves
somebody who just gets loaded and belligerent
and is asked ultimately to leave the casino, sometime
rightfully, sometimes wrongfully.
But when it's wrongful, a lot of the time the person
refuses to leave because they don't
feel that the security was justified
in telling them to leave.
Sometimes it's a person who's just
gambled thousands of dollars at the casino
and felt that they really spent a lot of money
and that the casino should be treating them well.
And instead, the casino, which has just
served them all these drinks is saying, you've got to go.
And so we see a lot of trespass charges
that stem from people who don't want
to leave when they're told to leave.
The elements of the trespass charge
are that the casino has to tell you to leave.
And then after being told, you have to refuse to go.
Now, that being said, a lot of the times
we have situations where our client disputes
whether they left right away.
Sometimes the security will say that they were told to leave
and they didn't leave promptly enough.
And sometimes we're arguing with prosecutors
over whether our client was on the way
out the door when they got arrested for the trespassing
charge.
But that's the most common trespass scenario
that we see in Las Vegas.
