Hi my name is Sarah Duff and I am the family based immigration manager here with Visanow.
For various years the immigration community has been waiting for the DREAM Act despite
various government efforts. On July 15th President Obama announced an executive order referring
to it as Deferred Action. It is important that everyone understands what Deferred Action
offers, the requirements needed to apply and what can be done at this moment
It is important that everyone understands that this will not lead to a legal status
in the US, such as citizenship or permanent residency, it only protects against deportation.
However there will be an opportunity to apply for a work permit. This status will need to
be renewed every two years.
The basic requirments to qualify for Deferred Action are:
- Need to have entered the US before the age of 16
- Have been in the US for the last 5 years - Are currently attending school , have graduated,
or posess a GED or have served in the US military - Has not been convicted of a felony offense,
significant misdemeanor offense, multiple misdemeanor offenses, nor otherwise poses
a threat to the community or national security - Cannot be older than 30 years old.
USCIS or United states immigration and citizenship services is still in the midst of creating
the process. However it is to our understanding that August 15th will be the day we can submit
applications. We still do not have all the information on the restrictions of Deferred
Action, however we do not believe individuals will be allowed to travel outside the US.
It is likely this will be a paper based application(not electronic) as well as require biometrics
appointment, and background check.
Currently no one is allowed to apply, I fyou submit an application it will be denied. What
you can do however is contact VISANOW. We can determine if you qualify, answer any questions,
