-As a former police officer, I'm often
asked whether the cops can access someone's Facebook
or Instagram accounts.
The answer is simple.
If you post something on your wall,
and it is visible to everyone, the police can look at it.
And they often do.
That's why we always advise our clients
to be very discreet in what they post on social media.
In fact, in a lot of cases, we'll
tell our clients simply to close down all their social media
accounts.
But in order for the police to get to your private messages,
things that you've only posted to a few friends,
they'll have to get a search warrant.
And if they peer into your private material
without a warrant, we can go into court,
get that evidence excluded, and likely get the case dismissed.
