Do you know why the defense attorney will often ridicule a demand that you make to try
and settle your case? Would you like to learn this information? Come join me as I share
with you this great information. Hi. I'm Gerry Oginski. I'm a New York medical malpractice
and personal injury trial attorney practicing law here in the state of New York. Today I'm
shooting from Las Vegas. I'm here at a seminar where I just presented some great information
and now I want to share with you this key information. You know, when an attorney tries
to negotiate a case they will often make a demand to the defense. The defense will likely
their first reaction will be what are you kidding? There's no way we'd ever pay that.
And so really it turns into ridicule sometimes. Where if they have a good relationship with
the attorney, they will turn around and say you're out of your mind. We're never going
to pay that kind of money. So that's why you'll often get that first gut reaction that really
is an attempt at ridicule to try and get you to reduce the amount that you're seeking in
your particular matter. So why is this important to you? It's important for you to understand
what goes on behind the scenes. Because once your case is in progress there's a possibility
that you can try and settle the case at any point during the litigation process or I should
say your attorney will do that. And you may not know everything that goes on behind the
scenes. This just shows you a little bit of what goes on when an attorney goes to his
adversary says Listen, we'd like to try and settle the case. The defense attorney says
well what's your demand, what would you like on this case. And now you tell him. He turns
around with a deriding comment like You must be kidding. Now give me a real demand. Well
the reality is that's just the beginning phase of the negotiation process. So why do I share
this? I share it with you just to give you an insight and an understanding into what
goes on in the litigation process in the state of New York. As always, if you have legal
questions, what I encourage you to do is pick up the phone and call me. I can answer your
legal questions. I do this every single day and I welcome your call. You can reach me

I'm Gerry Oginski, coming to you from Las Vegas. Have a wonderful day.
