Hello, I am attorney Mat Higbee here to talk about expungement in Orange County.
If you were convicted of a felony or misdemeanor in Orange County, California and you did not
expunged. There are only a few offenses that are not eligible for expungement.
You also must have paid all of fines, and you cannot be serving
any sentence or facing any new charges.
Expungement involves filing a motion and court order with the Orange County court where the
conviction occurred, unless it was a felony conviction, in which case they must be filed
with the Santa Ana court. It is often wise to include supporting evidence— especially
if your case is a felony that you want to be reduced to a misdemeanor. You also must
serve the District Attorney with a copy of the motion and everything that you provide
to the court.
If the District Attorney files a written objection with the court, you will want to file a written
response to the objection. If there is a court hearing, you should attend and be prepared
to explain to the court why you are deserving of having your record expunged. You can also
bring witnesses to testify on your behalf.
If the court grants the expungement, your court records will be changed to show that
you pled not guilty and that the case was dismissed. The court will also instruct the
California Department of Justice to update its records in the same manner. It is important
to know that expungement in California does not destroy or seal record, it changes it
by removing the conviction from your record.
Once expunged, you will have the right to say that you were not convicted, except in
three narrow circumstances, the most notable being when you apply for a government license,
such as a real estate license, or when applying for public office, such as city council.
