-In June of 2013, Governor Sandoval
signed Senate Bill 374, which allows for medical marijuana
dispensaries, to meet the needs of medical marijuana patients
here in Nevada.
Prior to the enactment of that senate bill,
we were a "grow your own" state, which
caused all kinds of problems, because a lot of people, quite
frankly, are not capable of growing
their own medical marijuana.
The bill, which takes effect in April of 2014,
will allow for the lawful creation of dispensaries
throughout the state.
There will be limits on the number of dispensaries.
For example, in Clark County, the legislation
will allow for the creation of 40 medical marijuana
dispensaries.
In Washoe County, the law will allow
for the creation of 10 medical marijuana dispensaries.
And throughout the rest of the state,
there will be limits of either one or two per county.
The legislation also allows for the cultivation
of medical marijuana to be distributed
to these dispensaries.
It allows for the production of medical marijuana edibles.
And it allows for labs to be created
to test the quality of the marijuana product.
With the enactment of this legislation,
it's going to be extremely important
that anybody who has any thought opening a medical marijuana
dispensary or related provider, that they obtain thorough
and comprehensive legal counseling
about all of the nuances of the law.
For a dispensary, there's going to be
a $5,000 non-refundable fee.
You're going to have to show liquid assets of $250,000.
You're going to have to show that you have
a property available, that there's zoning available,
so you can run a dispensary at that location.
And the law is going to develop with lots
of rules and regulations established by the counties
prior to April of 2014.
So it's going to be very important
that you get comprehensive legal counseling so you know
all of the rules and regulations.
Because if you run afoul of the rules and regulations,
either you will be denied a license,
or you'll have your license revoked.
Or you could be prosecuted for violating the law.
The federal government does not support the creation
of medical marijuana dispensaries.
And anybody who gets involved in this business
must know that they are facing potential prosecution
for violation of federal law.
But for the most part, there's reason
to believe that if you strictly adhere to the state
rules regarding the regulation of medical marijuana
dispensaries that the feds are not likely
going to take this issue on.
