I recently wrote an article entitled "Do I Need Padded Walls" on our blog that covers
the basic principles of landowner liability. The article's going to give you a brief overview
of when you can be held liable for injury on your property and some of the specific
situations that this may arise. First of all, the article is going to tell
you the two basic foundational facts that need to be proven in order to be held liable.
The first fact is whether you had possession or control of the property. The second is
whether you knew or should have known of the dangerous condition.
The article also goes into a little bit more interesting information about whether you
can be held liable for injuries caused by animals on the property and when this may
arise. The article also talks about inherently dangerous conditions and how you can be held
liable for those. The article is, like I said, intended to be
a brief overview of landowner liability and kind of a starting point for some future articles.
