So here it is the Massachusetts lemon law in brief:
Massachusetts lemon law covers vehicles
used for personal use; it doesn't cover commercial vehicles.
So that's the thing for you to now number one. Number two:
It extends for one year or fifteen thousand miles; whichever is shorter.
So the lemon law period is short and if your car keeps breaking after you
take it off the lot,
don't wait. One year or fifteen thousand miles is the coverage.
The vehicle has to be repaired three-plus
attempts or fifteen days out of service. So what that means is if your car
has been repaired for the same problem three times, and the problem still exists
after the third repair,
you have a lemon law case. Likewise, if it's been
repaired for 15 business days
for all kinds of problems doing that lemon lot period,
you may have a lemon law case based on the days at a service. But it has to be
business days, not calendar days.
Remember that. Now the trick in Massachusetts is that
lemon law claims don't
ripen just because your days out of service or number repairs requirements
are met. Instead you have to send a demand letter to the manufacturer
putting the manufacturer on notice that you have a claim
and allowing the manufacture a period of time
to fix the problem. Now, why do I talk about the demand letter?
It's the key. It's what enables you to then sue
the manufacturer or file in arbitration. If you don't ever send the proper demand
letter,
and that's the most important thing, proper demand letter. If you don't send it,
you don't have a case even if your car is in the shop for a thousand days.
Even if it's never fixed, you still don't have a case
unless you send that magic demand letter to the manufacturer.

Now, the important thing to remember is that in Massachusetts, if you are successful in
a lemon law case,
you may be entitled to repurchase of the car or replacement of the car
with a similar year make and model vehicle. In Massachusetts,
you're entitled to legal fees in a successful lemon law suit.
