A Lancashire family has claimed £48,000 in industrial illness compensation after a relative
was exposed to asbestos during the Second World War. Doris Timbrell passed away from
oesophageal cancer in 2008, but for years previously an x-ray revealed a number of calcified
plural plaques. This led to breathlessness and during the later years of Doris' life
her daughter Patricia had to care for her as a result.
During the war Doris had assembled gas masks in Blackburn and although the Ministry of
Defence admitted liability, it argued that the industrial illness compensation claim
came outside of the legal time limit. However, a judge at the High Court in London decided
that it was the effect of the asbestos that led to the claim coming later than usual,
though in this instance it could go ahead.
