Well, you're considering filing a Chapter Thirteen Bankruptcy and you're asking yourself
"am I eligible to file a Chapter Thirteen?" My name is Andy Forman. I'm a Business and
Consumer Bankruptcy lawyer in Tampa, Florida, and I represent Chapter Thirteen Debtors.
Eligibility is governed by section one-oh-nine-G of the bankruptcy code. It requires in order
to file a Chapter Thirteen, that you be a natural person, and not a corporation, or
an LLC, or any other entity. Only natural persons are able to file Chapter Thirteen.
There are other eligibility requirements that limit the amount of debt. Currently, if your
unsecured debt exceeds three-hundred and thirty-six thousand dollars, you're not eligible for
a Chapter Thirteen reorganization. You'll have to seek relief under another. If your
secure debt is in excess of a million, one-hundred thousand, you're not eligible for Chapter
Thirteen relief. You'll need to conduct an interview or a consultation with a competent
Chapter Thirteen Bankruptcy lawyer to determine if you're eligible and if Chapter Thirteen
meets the requirements of what you want to accomplish. My name is Andy Forman. Good luck
with your Chapter Thirteen Bankruptcy.
