Hi, this is Chuck Boyk
again, and I want to talk to you about the concept of a violation
of specific safety requirement that's called
the VSSR claim under Ohio Workers Compensation Law.
So under Workers Compensation Law you can file a
VSSR claim in order to further penalize the employer
for violation of the specific safety requirements.
In order to pursue such a claim we do several things,
first, when we meet the client at the initial conference we obtain
all the information and we also get the names of the witnesses
second of all, we're going to try to obtain witness statements from
the witnesses
third, we work with the client and file
an OSHA investigation. So we file
an OSHA violation report and
the Occupational Safety and Health Administration
of the federal government will do an independent investigation.
We will that use that independent investigation
to file the VSSR claim. After we file the VSSR claim
the Industrial Commission for the state of Ohio has peeled investigators
that will look into the claim and gather all the information
and then you and your attorney will work together
to try to win the VSSR claim and obtain for you
additional compensation for
the violation of the serious safety requirements.
