Hello and welcome to the JustAskBenGlass.tv program where every week we have a
new question for our national legal expert Ben Glass that has been submitted to us through
JustAskBenGlass.com. If you submit your own question at JustAskBenGlass.com
and it is featured on our program, we will send you a free copy of Ben's book The
Ultimate Success Secret. OK Ben, this week's question comes from Melissa in Arlington.
It's a very strange case involving a drunk driver on the W and OD trail. Now her question
is: is there a claim - and this driver struck someone on the trail - is there a claim, even
though this incident happened on a trail and not on a highway. Yeah, very strange case,
Charley, I'm very familiar with the trail, I've done a lot of marathon training actually,
so if you go out there you see bicyclists, runners, and folks on roller blades going
up and down, and this lady allegedly was driving drunk. I don't even know how she got on it,
she's driving her car down for several miles. Bunch of near misses and then she struck a
bicyclist. And, so the answer is yes, even though this took place off of a regular highway,
a regular road. If she has car insurance, then that insurance is gonna cover the bicyclist's
injuries and his claim for his medical bills, things like that. What's interesting is, you
know, a lot of times people don't have insurance. It's not actually required in Virginia, people
don't know that, but if you're - an important point would be - if you're a bicyclist and
you're hit by a car, often times you'll be able to look to your own car insurance if
the person driving the car has no insurance or they have inadequate coverage. Interesting.
So that'll be something that this bicyclist would want to look to in this case. Again,
I hope she had insurance, she's been arrested, I think she's still in jail. Hopefully the
bicyclist will have a great recovery, but if her insurance is inadequate he can look
to his own, whether it be Allstate, Geico, USAA, whoever. Wonderful, well Ben thank you
very much for your expertise, and if you have a question that you'd like to be answered
on the air, you can submit it at JustAskBenGlass.com, and if your question is chosen to be featured
on the JustAskBenGlass.tv program, we will send you a free copy of Ben's book, The Ultimate
Success Secret. Thanks for watching.
