Well, just exactly
evaluating an injury case is
is one of the
common questions of people who
legitimately want to know about their injury case. And it all depends.
Injury cases are analyzed
from the standpoint of "Is someone responsible for the injury?"
And, "Are there damages...
because
somebody did something wrong?"
and that's labeled as "Liability & Damages."
If there's liability,
in other words somebody responsible for
the damages,
that's of importance.
But if there are no damages, then
your value of your case is nothing.
So,
what I look at is
helping a client understand
what the value of a case is.
We look at the liability, and then look at the damages
and it's an injured persons responsibility to be able to prove
all of the facts that go into liability, and all of the facts that go into the damages.
And then once you are able
to prove the liability and damages
you have to make sure that the person who is responsible for injury,
who is liable,
has the ability to pay.
Because if somebody
has no money or no insurance coverage,
then you can't obtain a huge judgment for your damages, and it's basically worthless.
So all of those factors need to be analyzed
on a case by case basis
in answering the question, "What is my injury case worth?"
